The Department of Labor (DOL) continues its crackdown against employers for improper classification of workers as exempt when the employee is actually non-exempt under the Fair Labor Standards Act (FLSA). Beginning December 1st there is a significant change to classifying employees. The difference between Exempt and Non-Exempt is fuzzy at best for most people. The Department of Labor has made Employee Misclassification their number one priority in enforcement but the risk to employers also exists from possible employee litigation.
